My wife passed away May 7, 2004. Within a few hours I had been accused of murdering her by her family members. She died in a hospital ICU. The doctor told all of us at the time of her death it was acute pancreatitis. He asked if I wanted an autopsy to know positively. I did. I found out the sheriff’s department had gained access to my address book and also the tower to our computer, as they were also accusing me of being involved in kiddie porn. My youngest daughter called me that same day and told me the sheriff had called the house asking questions. I went to the sheriff’s office and spent time with the investigator answering questions. His comment to me was “someone “ in my wife’s family hated me. They were also telling people throughout the area I murdered my wife. The autopsy was done the state forensic department since the sheriff’s department was involved. It took thirteen months to get a final report from the autopsy. The findings were she died from acute pancreatitis. The members of the family who have been spreading these rumors and lies are the same ones who tried everything they could to provoke us into a divorce. I know at least nine people who have told me they were told, as fact, I had killed my wife. Do I have grounds for suit? The sheriff dismissed both accusations.

I'm sorry both for your loss and your odeal.

I suggest that you consult an attorney with the facts of the case. They are entitled to their beliefs and if the reports were made in good faith to authorities there may be no recourse since it is true, your wife died and that there was an investigation. The length of time required for a definitive post mortum report may have prolonged the agony and the cost to sue and to collect from grieving family members may be prohibitive. However, if they persist in claiming that you murdered your wife as opposed you were investigated re her death, while the results may be the same, there is a fine line between fact and slander/defamation.
