After filling out an Acknowledgement of Satisfaction of Judgment, where a judgment debtor has paid you for a, award, in full, does the document need to be filed with the court? We filed an Abstract of Judgment on this person and they need this Satisfaction to file with the county. They have been told that they DO NOT need to have the document filed with the court, in order to file it with the county. Is this correct?

My response:

You need to fill it out and send the original, with two-hole punched, to the court for filing. Make a copy, also, for conforming. The conformed copy will be sent back to you if you include a S.A.S.E. Then, once filed, you make a copy of the conformed copy, and serve the same on the judgment debtor.

Doing so safeguards you.

This person is trying to satisfy an Abstract of Judgment with the recorder. Does the Satisfaction need to be filed with the court
(to get the court stamp) BEFORE filing with the county? In other words, will the county record the Satisfaction without a court stamp on it first? Thanks

My response:

I don't know what the hell the judgment debtor is trying to accomplish with that; but, nothing is going to happen UNTIL you date, sign and file the original with the court. Also, remember to have the clerk stamp a conformed copy (with the court filing stamp), and then send the judgment debtor a copy of that. Also, make sure you attach a completed "Proof of Service" form to his copy, and keep a copy of that, to be attached to your conformed copy (get one from the clerk). That's your proof that you mailed it to him - - if anyone should ever question whether or not you mailed it to him.

On judgments where you have filed an abstract lien (in California) you must also send a conformed copy to any County Recorders in which you recorded the abstract.

Just do what IAAL suggested, except request the clerk send you two conformed copies.
