What is the name of your state? Wisconsin. I need info on how ACT 109 (Truth in Sentencing) would affect my friends' situation. My friend was sentenced in Sept. of 2001 of 3rd Degree Sexual Assault. He spent 2 1/2 years in prison and got 6 1/2 yrs. extended supervision. Truth in Sentencing (TIS) went ito affect Dec. 31 1999, but was revised in 2003. Any sentences handed down between Dec. 31 1999 and the date it was revised in 2003 are considered The Old New Law (or TIS I). Any sentences handed down after the date it was revised in 2003 are considered The New Law (or TIS II). Given my freinds sentencing date of Sept. 2001 He should have been sentenced under TIS I guidelines, however, they sentenced him under TIS II guidelines! My ? is: How would this affect his sentence and now that he has already served his confinement time and is on extended supervision what recourse does he have to get this sentencing mistake subtracted from his ES if any? Please help or direct me to a site where I can find the info. THANX
