In the state of Colorado I invested the 20% down payment for a home purchase with a personal loan to my daughter in December 2005.
I intended to, but have not yet filed a Deed of trust matching the loan note that she signed. The note I used was a downloaded form that is supposedly valid in the state of Colorado, but it has not been wittnessed or notorized.
Can I fillout a valid Colorado Deed of Trust form, have it notorized with her signature, and have it recorded using the note she signed in December?
I want to be on the Deed to protect my money, and she understands this.

In a related question, what would be the best way to be included on the Deed as a co-owner if she wants to have me take over payments and responsibility of the home?

Best bet is to talk with a title company about getting the deed and everything in order. It might cost a couple of hundred bucks, but at least you'll know everything is done right.
