Okay.. so I came to the US as a tourist to visit my boyfriend. I was supposed to be here for about three weeks.. but it's been over a month now that I've been here. We're considering getting married and applying to adjust my status so I can remain in the States. We're aware of the 30/60 day rule and we're planning on waiting at least two months until we get married. Now, the problem that I have is that when we were crossing the border (he came to pick me up in Canada and drove me down to the States)we got kinda sketched by the border guard. The border guard talked to my boyfriend first and then came and talked to me.. he asked me if we were getting married.. and I told him "no" thinking that he was asking whether the purpose of my trip to the States was to get married. Then he told me that my boyfriend just told him that I was his fiance.. and I told him that we talked about it and were thinking about getting married at some point.. but not like the next day or anything. I told the border guy that he confused me.. and I told him "no" because I thought he meant was that purpose of my trip to get married. Anyway.. my boyfriend and I had discussed getting married before.. and had even started the K1 process.. we sent away our forms.. but I think they got lost because we hadn't heard that they recieved it or anything and it had been months. We told the border guy that yes.. we would probably get married one day.. but it wasn't our plan.. which it wasn't. So we had a big ordeal at the border but finally got across. Now I've been doing some research on filing to adjust status while I'm in the States and I was wondering if I'm going to have any problems because of the episode at the border. I mean we told the guy that we were planning on getting married at some point. But would the fact that i said "no" at first be considered lying? I mean what do these people keep on record? Once we got inside the building and had to talk to the INS people nothing was written down or anything. The piece of paper that we'd been carrying around was in the end thrown out by a customs officer and we were sent on our way. But the initial customs officer ran off with our passports for awhile. I'm confused and nervous about this whole thing. Will it affect the approval? I need some help to easing my mind.. and some options of what I can do.. or what I should do. Help, please!

If this agent reported this information or placed it into your file, then yes, you are going to have problems. Also, if the K1 application reached the INS, again, you are going to have problems at the AOS interview.

Since you have now overstayed your visa, your options are very limited.
