What is the name of your state?FLORIDA Hello I have have requested under Florida law , Specifically Section 120 of the Florida Statutes (F.S.) An Administrative Hearing . I have been denied is there anything I can do ??? Is it leagel to be denied ??? I filed directly with Division of Administrative Hearings and the reply from them was I had to file with the agency having jurisdiction over the matter . I had informed the judge that the agency has refused to comment to my first and second requests and I don't think the desision he has come to was fair . Please help me to get my fair day in front of the judge thanks ;-)

Please explain what you are talking about. Thank you.

I can tell you in general that you must exhaust your dealings with the agency first before you can appeal it to the administrative law judge.

But you must give us more facts and details.

I have not received any official reply in the request for a hearing just phone calls trying to stall me .They are more slippery than a used car sales man. I will now reinform them this is past the negotiations stage and needs resolved . This hearing I have requested is with the florida department of environmental protection .They allowed a developer to bring in several loads of fill dirt in to the flood plane ae with out proper permitting . This permitting world also of required a engineer to certify the project . As a result of this I have been damaged and continue to be impacted during heavy rains in florida . I am the new run off for the property. I think they are only worried about their assets and not doing the right thing . I have informed them that a after the fact permit would currently be unacceptable. I want the fill dirt removed .
