It has been found out the the Adminstrator of my mother estate committed purgery by putting her name down as a heir to my mother estate (mother die w/o a will). She is using the claim that she didn't know she could put her name on the list. Will there be a chance that she will be bought up on charges and if so what could be the punishment? We have petitioned the court for her removal. Which she is fighting all the way. We also think she may have spend some of the estate money. Since she will not turn over any cancelled checks and statements to our attorney.

Perjury has a very strict legal definition and that may not apply to what she has done--what she did might be considered an innocent mistake because she was ignorant of the law. She is not going to be automatically "brought up" on charges, you or whoever has a complaint against her will have to file charges. As of yet you have not provided proof of anything definitive that she has done wrong. So what if she spent some estate monies--the problem is what did she spend it on--authorized expenses or kept the money for herself?

She doesn't have to turn over anything to your attorney right now if she is the official administrator, but you should kindly ask her for an accounting--that is what you have a right to. Why not just wait until probate has nearly ended--at least find out what you are going to get from the estate--before trying to accuse this person of wrongdoing.

Thank you. She was advise by the family attorney before she became the administrator that she was not a legal heir, since she was a foster child and never adopted. The legal children also told her before she took her duties the same information and not to do this because she could get in trouble. She also left some of the heirs of the list and never notified the ones that she did put on the heir list. She also stopped contacting the heir that lives local. Also when the heir sent the corrected list to the commissioner. She received a call from the husband of the admininstor asking why did she send that list down to the commissioner? She was asked to go down a correct the list at the circuit court and send all heirs copies of the inventory per their request that was over 5 months ago. That was never done.

These actions show incompetence and you should at least be talking to a probate attorney to find out how to get her removed and replaced with someone else.
