What is the name of your state (only U.S. law)? IL.
Hi I was wondering how do I go about adopting my stepdaughter who is seven years old and will be 8 in Jan. Her Bio father has never paid child support and hasn't been in her life since she was a one and half years old. I married her mother in 04 and i have been the provider for the family. Since 04 I have claimed her on my taxes and paid for all medical expenses and schooling. The Bio father is currently moving from state to state and the last time we talked he said he will never sign over rights to her.

when was the absolute last time mom talked to dad?

Not true. Does it make it harder? Yes. But if the parent has not been in contact of paid support for a significant amount of time anywhere btwn 6 months to 2 years depending on the state then yes they can file to terminate dads rights based on abandoment. If they dont have an address for him or a way to contact him then they can file by notification.
