Adopting my Miracle from a Rape.

What is the name of your state? Ohio

My daughter is a miracle from a rape. The rape occured in 1992 and they never caught the rapist.

I couldn't work for years after the rape, so I applied for welfare. I had to give a name for the "missing parent" or I couldn't get benefits. So I gave John Smith (I have no idea who raped me).

Now my husband wants to adopt her. This is the only Father she has ever known.

Is this going to be a problem?
Do we still need parental consent?

first of all, you are only required to show good cause in refusing (or being unable) to give parental information to obtain benefits, No one is going to make you make up a name for an unknown father. So your story starts by being slightly unbelievable.

Apparently, there is no father named on your child's birth certificate?? and she is now, what 14 years old correct?

Go and get a consult with an adoption attorney in your area. Obviously you can't obtain parental consent from an unknown rapist. A local adoption attorney will have the best answers to your questions, and you will need to hire one anyway. Adoption is not a DYI project.

Actually, in straight-forward situations, it can be a do-it-yourself project. However, you are correct that, in this situation, an attorney is required.

You're going against the general legal line here, Zigner. Are you an adoption attorney?

Im sorry Fairisfair but I had to respond to what you posted here. I have heard of this happening MANY times. Actually, my god daughter's "father" has a ficticious name of "John Smith" also. Product of a rape. County demanded a father's name for mother to obtain a lower income daycare service. She explained to the caseworker that she had been raped and it had been reported. The caseworker informed her that she HAD to give a name so she did. It is what came to mind.

I agree that it is not an unbelievable story, but depending on the situation, it could be fraud. It is possible to have the father "named" as a John Doe (or in this case, Smith) when the father is truly unknown, but there is a procedure to follow in order to do this LEGALLY.

Hopefully, the SOL on any possible crimes mom MAY have committed have long since past. However, it would be best to discuss it with an attorney in the area that the possible crime was committed in.
