Adoption Board??????

I posted a question a while ago but I haven't heard anything yet if there is anyone with any information at all please respond. I have a three year old. My husband has raised her since birth, bio hasn't seen her since birth. My husband wants to adopt her, however bios mother (who also hasn't seen child since birth) wont let him willingly sign over his rights for adoption, is there anything we can do. I was told that we could just get a lawyer file for adoption and send the bio papers and take it from there. Can he fight it? His wages are garnished for cs. Thanks from Kansas.

You need to have both bio parents terminate their parental rights if neither one is involved. If they refuse, you need to file for ex parte decisions (child abandonment).

It would be worth a try to start adoption proceedings. Retain an attorney, and start the paperwork. The bio Father will get papers and if he wants to fight it HE will have to step forward and contest the adoption. You never know, he may receive the papers and not do anything. Then, when he does not show up in court and files nothing to stop the adoption, it may be granted. It's worth a try.
