What is the name of your state (only U.S. law)? VA
FYI - i posted most of the information related to my question under the "Child custody and visitation" section.
The situation is that my step children's sister (they share a mother) was abused by her stepmom. when CPS showed up at the house the bio dad gave her up and granted temporary custody of her to the biological mom's grand parents (bio mom died a couple of years ago). The great grandparents are scheduled to go to court soon to finalize the custody so that they retain full custody and bio dad will most likely try to keep his visitation. For the past couple of month's he's been skipping scheduled visitation appointments and doesn't bother calling to say when or if he has decided to take her for weekend. she's scared and cries every time she has to go over there.
My husband and I have discussed with the great grandparents possibly adopting her because they really aren't in a good position to keep her (even though they love her very much). If the great grandparents are granted full custody and the bio dad get's visitation rights would we possibly be able to take her in? if the dad grants the great grandparents full custody of the girl, but retains visitation would the great grandparents legally be able to let us adopt her or at least grant us full custody. We would like to take her in so that she can grow up in a stable environment along with her only siblings. What do you think?
