What is the name of your state? North Carolina.

My husband has been calling 37 times to a women and text messaging her 349 times in a month. He says that he is helping her go through a divorce. But I was contacted this morning annonymusly and told that they were having an affair. He has hidden text messages from me and deleted her phone number from his phone. He tells me that this is just a rumor. My question is them talking and texting all the time is it considered adultery and or alienation of affection

Q: My question is them talking and texting all the time is it considered adultery and or alienation of affection?

A: No. But him having sex with her is considered adultery and/or alienation of affection.

Yes! Talking and writing to another woman IS adultery!! Divorce him!!

Now, my wife will need to divorce me because I'm writing to you! Oh, God, when will the circle be broken??

Telephoning and texting a woman might not be adultery in NC but it could be grounds for divorce under "Offering such indignities to the person of the other as to render his or her condition intolerable and life burdensome. "

IAAL, you may breathe easier, CA is a no fault state so you may continue to be burdensome!
