i live in california. i have been seperated for over a year and am filing divorce on grounds of adultery. my husband has since left california for another state. am i entitled to a divorce on grounds of adultery if i can prove he had an affair? and does california have "fault" grounds that i can file?

My response:

California is a "No-Fault" divorce State. There are only two grounds for divorce : (1) irreconcilable differences that have caused the irremedial breakdown of the marriage, (2) or incurable insanity. [Fam C §2310]

Adultery is no longer a crime in California, and also is no longer grounds for divorce. As a matter of fact, adultery has no force or effect on the division of assets, liabilities, or child support, visitation or custody.
