What is the name of your state? Va.
I need some advise in this matter please, My husband and I have been living apart
for a year, he has never filed for seperation or divorce. We have been having sex up until
about 3 weeks ago when he informed me that he has a girlfriend and they have been having sex so he now wants to get a divorce so he can marry her. She also is married and has told her husband she wants a divorce. This has been very difficult for me and I'm not sure what I can or cannot do as far as the law is concerning adultry & divorce.
Married 7yrs. No children
This may not be enough information so please let me know what else you may need, so I can get the right advise.
Thanks!

The adultery can be used as grounds for the divorce, but it sounds to me like you want to know if you can take legal action against them for having the affair.

Virginia has abolished "alienation of affection", so no legal action for that.
