Why don't they just live in the same car? Unless it is a compact of course.

Seriously, divorce the bum and move on.. even if you are able to (only NC allows this type of action), this path of litigation is very difficult to win. You have to be able to prove, that without any shadow of a doubt, that your marriage was rock solid and you were both extremely happy until this 3rd person came along. You would have to prove that this 3rd person purposely set out to take your spouse. You would have to prove that you were blissfully happy with life and roses were blooming in the garden.. etc..

I agree with legalbeagle. But, "shadow of doubt", that's a heavy burden.

I agree.. but it is difficult to show that a 3rd party caused the breakup of a marriage that was falling apart in the first place. In the now famous case in NC, Dorothy Hutelmyer stated that her marriage was "idyllic". She honestly believe that everything was great (despite not having sex for several years, but I think that might be a NC thang). There was no slow breakup of the marriage, he just announced one day he was leaving, and that was the first she knew anything was wrong.

Personally, I like the original thought on the law, that wives are considered 'property'.
