What is the name of your state (only U.S. law)? New Jersey

Hello,

I'm in the process of setting up an advertising website for New Jersey and for NJ advertisers only at this point.


First Step:

I will be scanning actual business cards and posting them on my website along with some text that is on the business card.....ie: name, phone number, address and any other info that is ALREADY on the card.

Second Step:

I will post and make visible that they can buy advertising on my website using the format I mentioned above.

Third Step:

If the owner of the business card says no to purchasing the advertising program, can I leave them on the site for content.

My contention is this:

1. They have given me the card
2. The card is for advertising
3. It is given out as an advertising means
4. It is public domain once they hand it to me.

My question to you fine people, is it legal for me to do what I've explained?

I have a registered business and Tax ID in New Jersey.

The order you listed your plan is incorrect.

First. Sell advertising to potential customers. Use existing customers that have bought adverstising or use phony business cards to give an example of your website.

Second. If the business buys into your plan, post the business card on your website.

Third. If they say no, continue pounding the pavement looking for customers.

If you want to follow your plan, get use to the term "cease and desist" and have some spare cash on hand in case you need an attorney if you are sued.
