Similiar post to a previous one, just hoping to get some more advice.
Ex-wife filed affidavit and claimed arreas in 09/01. NC CSE filed complaint against me 09/01, hearing held 12/01 which my atty presented evidence in my favor and NC CSE voluntarily dismissed their case. Judge asked both parties to reach settlement.
My atty repeated sent letters, etc in effort to reach settlement with NC but they never responded. NC CSE never filed motion to reopen nor resubmitted a new case with regards to the 09/01. Ex-wife filed another affidavit 8/02 claims arrears of 25k unlike the 5 months arrears she claimed the year before which BTW was dismissed. NC CSE sent instructions to VA CSE stating the 25K arrears were adjudicated against me and to begin proceedings to collect.
Hired an atty, filed an appeal contesting all of their actions, atty presented evidence and during a 5-6 month period VA CSE repeatedly contacted NC CSE and asked for proof surrounding their claim. NC CSE never responded to VA CSE and their case was dismissed by VA CSE. In doing so, VA removed entry from my credit file and removed the liens from my tax filen.
04/04 received notification from Federal Mgmt Svc that my federal tax return was intercepted applied to a debt. Basically, NC CSE filed this lien after their case was dismissed from VA CSE with legal standing or merit. Are their any sanctions or actions I can file with the Federal Govt, NC or any related agency compeling NC CSE to halt these illegal actions. Any assistance or advice would be greatly appreciated. BTW NC never sent legal notice that they were planning this action. This was done behind the scenes. Any ideas on what I can do, agencies to contact would again be extremely helpful. thanks in advance.
