I am in the Military stationed in VA. My wife and I are separating starting Monday. We got married in CA and are both from OH. My question is, can she legally take my daughter out of VA? I have to stay here because I am stationed here. Can she up and leave and to to another state?

Hello Dave. let me tell you I'm no lawyer.
Unless there is a court order for her not to leave the State of VA then she may do as she pleases. If your going to divorce in the future then you better pick your battle. Cali is the most harsh 2nd is VA and I'm not sure of OH. This site has a link for you to check the statues. Also check out Militarydivorceonline.com send me an email @
