Advice for Garnishment Hearing?

What is the name of your state? Ohio

I am requesting a garnishment hearing to try to reduce the amount that the CA is trying to garnish from my wages. Right now, the calculation would come to $851.18 per month which we can't afford.

I plan to take a copy of our budget along with copies of all the fixed and variable expenses for our family to show what a hardship $851 would be (we'd lose our cars and our house at that rate). I'm also planning to bring copies of our tax returns to show that I've been the head of household for the last 18+ months.

Any words of advice on what else to bring to court to plead my case?

Sounds to me like you've got all your ducks in a row to prove the garnishment would be a hardship. Good Luck !

*** Actually, I doubt that the courts would reduce that by much. Ohio follows the federal exemptions of the higher of 75% of disposable earnings or 30 times min. wage. In order to get the $851 per month garnishment you claim, your disposable earnings would have to be in excess of $3400 per month, which would probably come out to something like $4200 to $4500 per month!!!

*** Head of household has no affect on Ohio exemptions.
