I am in dyer need of some legal advising. The following are facts concerning a very dear friend of mine. About three weeks ago he was charged with trafficking 103 pounds of marijuana in California. He plead guilty and his case was plea-bargained to Felony Transportation of Marijuana Stat11360(A) and is currently in custody and will probably have to serve 6 weeks. The big problem now is he was booked under false identification because he is a resident alien and was afraid of losing his alien status. He had permission to use the alias, but now the alias is threatening to inform the court of the perjury. What will happen if my friend comes clean and tells the judge about the alias and what will happen if he doesn’t? Also, I have had contact with the defendant – can I be charged with perjury? And what about the person who gave permission to use the alias information in the first place?

As to you being charged with perjury, have you given any statements under oath that were false?
I am surprised that someone gave permission to use their name as an alias in a criminal trial. Although they gave "permission" to use that name, they probably don't want a criminal record.

No, I have made no statements under oath. I have only been in contact with him and his public defender via the telephone and through letters. I am really more worried about what will happen to him because I know he needs to tell the truth, but I don't know what will happen. Please reply.
