Hello all, as you know since ive posted before I closed on my new home today. Not without some trouble. We had the whole tax thing straigtened out. The sellers were supposed to up the concession another $1000 and the mortgage company was removing some fees for us. The Mortgage company called this morning to tell me that I needed to bring a check for $533 to closing, fine, better than the $2100 they hit me with on Friday. So we went and did the walk through and whatnot. One hour before closing, we get a phone call from the lawyer which starts out "You are not going to like this" Truly, I hate when they do that. Anyway, to make a long story short, someone got their lines cross and after being guaranteed this morning that I only needed to bring $533 to closing they tell me no, you need to cut me a check for $2300. The mortgage company LIED to us when they told us that the seller upped the concession the seller actually wanted to RAISE the sale price of the house. We were getting a check for $4600. to get the roof repaired on the home as it desperately needed it and we need to do it to keep our homeowners insurance. We ended up taking a hit on the $4600 and only getting $2500 of it because we did not have the $2300 readily available. (We had NO IDEA they would do this ONE HOUR before closing). My question is (sorry this is so long) Do we have cause to persue legal action for Misrepresentation by the Mortgage Broker?? Anything you can offer will help. We were constantly lied to through this entire process and feel as if we did not get treated fairly or properly.

First, what are your damages? The loan went through and the figures were apparently correct. No damages, no legal case. You can report to BBB if you want, but loan originators are usually very imperfect, passing along what info they know, doing whatever they can to get the loan to closing. They cannot change the terms of the contract, they cannot bind the seller to any new terms, they can only suggest ways to get the deal done. Also, it is not uncommon for sellers to raise a sales price and offer more concessions.

In the end, they were off by $1,500. if you are convinced that these changes were legit, I would let it go...
