Well, considering your car's potential value just dropped from around $90,000 to about $25,000 I'd be really pissed off if I were you. I'd be mad enough to make a trip to MI to face the guy down personally. Hmmmmm, actually, he sounds like the guy I bought my '66 Mustang GT convertible from last year (Ebay). It was supposed to be an absolutely rust free easy restoration. Yeah...so far I'm in about $10,000 not including the price of the car and the rest of the work. Your seller's name isn't Barry Hale by any chance, is it?


In 1987 I did a ground up resto on a '62 SS vert, and if I remember right GM really didn't have a designation for the SS package in the VIN or trim tag. If it has all the correct trim...including the correct rear panel and ALL the interior bits...it may be still considered an "official" SS. The engine is an entirely different matter. A 409 SS vert is solid gold. I had friends back in the mid-60's who had 409 SS coupes, but the vert is really rare. In fact, the guy who soda blasted my Mustang has a SS 409 vert with a bench seat. I'll ask him for any details if you want, or if there really is a GM identifier that will reduce the value of yours.

As far as your seller goes, obviously he sold you a car that is not worth nearly as much. Have you checked to see if he sells regularly or is a dealer? Lots of guys out there act like hobbyists when they really turn a lot of these cars. Some get 'em cheap and add the trim packages to make big bucks. I know there are "services" who will make a new trim tag to match the car for about $250. I considered doing that on my '67 GTO before I sold it because it had a color change, but it sold so fast that it didn't matter.

You can sue him, but you will probably need to file in MI. You can file in CA, but he can file to deny the jurisdiction. Then, you have the problem of collecting. I still haven't filed against Barry yet, but will if I get a MI attorney in or close to Flint. Has he offered to "undo" the deal? Legally, he has sold you something other than what he claimed, but if he added any disclaimers you might have a problem. Did yoou have anyone inspect it? I think a judge might ask why you didn't verify the engine #. Did he lie about the #?

Holy crap! This guy really misrepresented the car. If you paid what you should have for a 409 SS you are miles away from the value of a standard vert with an incorrect engine. Don't buy his crap about not knowing. He advertised one thing and sent you something entirely different. This is worth a lawsuit in any state...and possibly filing fraud charges. Tell him you are considering BOTH legal actions against him.

Care to give me some figures?

You would have to file where he is, then it would be iffy. I personally don't think you have much of a shot. You would have to prove he knew it wasn't what it was. Also the burden of proof is on you and you should have had the car checked out before purchasing. Usually a deal that is too good to be true, really is.

First, you paid a very good price IF the car was what he said it was supposed to be. Because it is not, you'll have some choices.

Second, (and concerning your choices) do NOT use bondo or any kind of plastic filler to repair the body.....unless you are ready to give up on the car and sell it as a standard vert "driver". Even then it should be done "right". If you plan to build a good clone spend the $$$$$ and do it right. Even a very good 409/4spd/vert clone can bring $50k. But, you need the metal cut out and replaced, the car entirely blocked and prepped to be laser straight. Use high quality primer and paint..as close to the original color(s) as possible. Replace ALL the trim with SS trim (machined swirls are extremely important). Replace the ENTIRE interior (maybe not the original steering wheel if it is really nice). Don't leave ANY pitted cgrome or stainless. Strip and repaint every piece that has body color, interior color, underhood colors, chassis and underbody color, etc. A new top is a must, as well as a good mechanism.

Be prepared to pay at least $10,000 to do this if you aren't going to do much of the work. $10K + $17.5K is still only $27.5K. That's still worth it IF you had a 409. I forgot you had a 348.

You know what? Get this liar on the horn and tell him either he refunds your $$ or you'll get the authorities involved. You can't make this car right without the 409 and a lot of work. There are better '62 verts out there to start from scratch on...for less than $16.5. Anyone who had possession of this car would know that it was NOT an SS....especially without the correct trim. What kind of title did you get with it? Did he actually have it in his name? You should be able to track the previous owner and get the rest of the story.

$17.5k is worth going after. Or, ask for him to come up with a correct year 409 and all the correct trim. That would put you back in the ballpark. Since you overpaid by at least $6-8K, he should be glad to find and ship you the stuff.
