My husband is having problems in regards to communication about his children. We have tried to send letters but the mother will not sign for them. He has tried to call her and she won’t pick up the phone. He has sent emails to her lawyer and he VERY rarely responds to them and never comes out and answers the questions that he has asked. So as a last resort for their winter break we decided to email her directly. She is saying that we cannot do that since she has a lawyer and that we have to stop. Do we legally have to do this? I figure she can just delete the emails if she doesn’t want to read them. We are at wits end here and her lack of acception any communication is aosting my husband thousands extra for plane tickets. i.e. he is allowed to have 1/2 of the winter break for the kids. We purchased plane tickets but sent mom a letter almost 3 months ago stating that we were willing to change the dates if they did not work for her but she refused to sign for the letter. He attepted to call her to no avail (19 times). And the letter that we sent to her lawyer has not yet been answered and we sent that 2 months ago. Now she wants the dates changed and they were supposed to be out here on the 21st and it will cost an extra $1,000.00 to do so.

has he been denied other visits? is there any mention in the current order regarding him having phone communication with the kids?

he has been denied roughly 15 differnt visits over the past year and a half. We have drafted the paperwork for contempt but we are waiting for Christmas break to be over in order to decide if that can be included in the order. Yes, is is supposed to have telephonic communication with the children at least 2x a week.

why in the hell would he risk not seeing his kids at xmas (and lose the$ for the tickets) just to have one more strike against her? that's ridiculous, if the contempt were file on tomorrow you can bet that mom's lawyer will demand she send the kids for xmas

Because we are a low income family, we don't have credit cards and we sure as heck don't have 1000 to spend.

We bought the tickets for $198.00 there and $198.00 back she is saying that she wants the date changed (mind you this should have been taken care of 3 months ago but we haven't been able to get ahold of her). This will cost 1400 to buy the new tickets. My question was can he contact her via email or can she say we can't contact her because she has a lawyer? Legally doesn't her lawyer have to forward these letters to her anyways? Could he get in trouble if he continues? He sends a copy to her and a copy to her lawyer so if she doesn't want to read it she doesn't have to because her lawyer gets a copy too.
