quick question: the situation, briefly, is that my family are american citizens living in europe. (we lived in ny and nj, mostly nj). we moved to europe a little over 10 years ago. 2 years ago my father (aged 58) left my mother (aged 57) for a 22 year old. unfortunately, my mother has been experiencing financial problems due to this split and the european lawyer she has been using has not been very helpful. our question: in this case - does american or european (this countries') law apply? we are certain that american law would protect her rights much more than this countries' does.

European law would more likely apply. Now, if your mum moved back to the US and lived here for say, a year, she could then apply for things under US law, but is it really worth all that trouble?
