Santa Barbara, California.....I am being sued in small claims court for breaking a 6 month rental lease by an angry former roommate. I signed a lease for 6 months to rent a room on November 1st, 2000. In March 2001, I asked my roommate if he would let me out of the lease early due to knee problems, 2 surgeries, and my room was upstairs. He agreed that if I helped him find a new roommate that I could move out on the 15th of April. I placed an ad, it was answered, and in the first week of April I witnessed the new lease agreement between the new tenants and my roommate. I moved out on the 9th of April, and the new tenants moved in on April 15th. This was months ago. Last week, I called him and asked him for the $75.00 he owed me for a BBQ that he wanted to keep but I had paid for. He got angry, and filed small claims on me for breaking the lease. I am countersuing him for the BBQ, and have witnesses that are willing to testify for me regarding the new tenants. I have a feeling that he is going to write a new lease and lie about when they moved in. If my signiture is not on that lease, I know it's been re-written. I am having trouble filling out the small claim paperwork. Am I the Defendant in all instances? Am I the defendant on all the paperwork? HELP
