I'll get to the point without telling the story, does a man have a legal leg to stand on when it comes to requesting his parental rights being severed?
My husband fathered a child 12 years ago. He wasn't there for the child since 3 months in utero. The mother always (falsely) claimed he was abusive to her and that he tried to kill the child, so he has never seen nor will see the child.
CHild support was established right after the child was born. After paying for about 2-3 months the mother had gone to court claiming she was so scared of him she wanted him cut off totally and did not want financial support.
Now it's 12 years later, she found out he is married with a new baby and she's running off to court to file for child support.
I have heard that depending on state law, if there has been no support nor contact with the child after a period of time the CUSTODIAL parent may go for termination of the other parents rights. The twist to this situation is that SHE REQEUSTED that he not see nor pay for the child for the past decade. Does he have any recourse now?

my situation

Not sure about your state laws ..but i can tell you about my situation which is almost similar but not exactly but it might answer a few questions..Years ago I had a son out of wedlock at the time the father wanted no part in anything as he always thought he would get back with his ex..After 13 years he all of a sudden decided he wanted to be part of my sons life...what i was told was as long as the fathers name was on the birth certificate he was legally responsible for the child till he was 21..however if the name is not on the b'certificate she can take you to court and get child support ect. Which is what happened to us but by the time everything was said and done the court only ordered him to pay $25.00 a month which still left me responsible for everything else but it all came down to court takes time and by the time it was all said and done my child was 16 years old and the judge pretty much didnt care what either one of us wanted but left it all up to my son. Also I would see if your husband has any of the paper work from before if he was abusive was there a restraint against him anything he might have to help him prove anything as if the allegations are on paper you might be facing a whole different situation.
