What is the name of your state? VA
My ex-wife (CP) filed non-support allegations in 2001 in NC through CSE, hired local atty, case dismissed in my favor. My ex-wife files false arrears affidavit with the same agency in 2002, this agency forwards affidavit as adjudicated arrears to VA. VA files action against me in 2003, hired local atty, VA CSE drops the case in my favor because the arrears were never adjudicated.

NC CSE knows that the forwarded complaint was dismissed by VA CSE, goes forward and files a lien with IRS in 2004. Hired local atty in late 2004 to files notice and presents evidence to NC Ofc of Administrative Hearings. OAH decides I have a case and begins proceedings, however have been waiting for a hearing for the past several months, it seems that is a huge backlog. Well, my currently atty is being a jerk and not returning my calls, etc.

I'm seriously considering replacing him, but he's been with me for a couple of years now even through the stuff mentioned above. I just don't agree with how my atty has been treating me, not returning calls promptly and sometimes not responding at all. Does anyone have any advice on representing one's self at one of these hearings. At this point, there have only been supporting docs submitted, just awaiting a hearing. Thanks in advance for your suggestions. My apologies if its a little long, I just wanted to be sure I gave as much info as possible.

I understand your frustration about your attorney not returning your calls, but look at the overall picture before you make a decision.

You have an attorney who has been with you for several years and has obviously done a good job in getting the messes straightened out, is there any reason that you believe he isn't doing a good job on your case now?

My personal suggestion- keep your attorney and be patient about him returning calls, because if you get another one the new one may not do such a good job, and this is something that you don't want to try handleing yourself. Good luck.
