Hello, I purchased a home in August 2002 with my boyfriend. We got a joint mortgage. He has recently become abusive and I am trying to figure out what I can do to get one of our names off of the mortgage. He put down 30k and we have no written agreement regarding separation. I have been approved to refinance the home in solely my name, but he would need to sign something to release his name. He refuses to release his name or mine, even if I can repay him the 30k. What can I do? Can I force him somehow to release his or my name, or am I stuck for the next 30 years? Thank you very much for your responses.

Unless one of you refinances it in your name solely, there is nothing you can do. Even if you could get a court order or sign over the mortgage company is still going to hold both parties responsible. On the bright side he can't ever sell it or do anything with it either. The two of you will need to come to terms or you will both be scr*w*d in the future.

Thank you for the reply. I am approved to refinance, but he refuses to remove his name. I can't refinance without his consent. Oh, well.

And my response greatly differs from yours.

noted and thanks for the info. Typically in these circumstances I am coming from the mortgage company prospective and have never heard or that or seen it happen here. It does give me great info incase it ever comes up again. sorry OP it appears you may not be scr*w*d afterall.
