Affidavit Certifying Medical Records

Ok, I have requested medical records from several docs that the kids have seen. With one exception, the offices have said that their records copying place will have their own affidavit that they will sign/have notarized/etc.

I have an affidavit prepared for the remaining doctor. I found the affidavit on the missouri bar association website, so I know it's correct for the state/court.

SO... it ONLY states at the top "State of Missouri" "County of X"

Do I need to add the case number? Or is that not relevant for the purposes of the affidavit?

By leaving it off, can I use this later/in other court actions?

You're supposed to, but odds are no one will reject the aff if it's missing.

1) No. That's unethical.
2) No. Even if it wasn't unethical, how do you propose to submit the original aff in this case, and yet use the original aff in subsequent cases? ;)

But if I put it on there, it's not going to bung up the works, yes? I don't want SH's attorney to have ANYTHING 'real' to b*tch about when it comes to the admission of the med records.

Oh. Duh. LOL

I was thinking "Hey, I can use these records (in whole, not just the affidavit) for the contempt thing and still have them for later!"

I wasn't thinking "Actually, the COURT will have them."

Because I'm sometimes less than linear in my thinking. Which is a nice way of saying scatterbrained.

If your courthouse has a subpoenaed records room, you may be able to leave the records + original aff in there for use in subsequent cases. Otherwise, you'll have to "re-create" the wheel if you need them again.

And if you're worried about the other side being nit-picky, then definitely put the case number on the affidavit.
