after 2 months on lease, suddenly apt/condo management wants $ for new gate card

i've been renting this condo for about 2 months so far haven't needed anything to enter the place because the gate hasn't worked, but now that they are about to fix it they will be charging all tenants for a card required to enter the community. I'm wondering if the landlord would have had to mention this somewhere in the lease agreement or not and if so and they hadn't, wouldn't they be responsible for this cost? otherwise would I be able to legally use this as an excuse to break the lease free of penalty? any one have ideas on this one? Thanks in advance

How would the landlord know that the association was planning on fixing the gate sometime in the future and that cards would then be provided to the residents/tenants?

This is not a legal reason to break your lease.

well then I guess my question is how many things can a tenant be held responsible to pay for that aren't mentioned in the lease? I mean, would a charge like this technically be for the landlord? and if so, and he/she wants to put that on their tenant, wouldn't it originally have to be mentioned somehow in the conditions of the lease? thanks

Did your lease include a parking place inside the gate? If not, park your car outside the gate if you don't want to spring for a card. If you were given a parking space per the lease, ask the LL for a card.

well yeah, each unit has assigned parking spots. I would think things like access to your place would be taken care of by your land lord. So since the management is placing notices at the mailboxes telling tenants they will need to pay for a card, I'm assuming unit owners aren't being asked, or aren't planning to pay for the cards, which doesn't seem right. I would think they would have to mention this sometime upfront, just like the cost of a security deposit or the cost of rent. Wouldnt be the same if they didn't mention a security deposit, but then months later asked for one? Or if they never mention the price of rent, but each month gave you a random number? Or maybe that's not a good example. Well, how about the cost of repairs, which is mentioned as a cost of the landlord's unless it's determined it's the tenant's fault. I'm thinking that any costs to imposed on the tenant have to be covered in the details of the lease otherwise the landlord is responsible no?

i haven't found out yet. I don't like arguing things I don't know about and I'm sure if I ask either the landlord, which i'm not in contact with, or the management, they'll just tell me what they feel like, hence i'm inquiring about the legality. I'll keep looking on the internet about landlord/tenant law. I guess my question to investigate should be what types of costs can a landlord impose upon a tenant that aren't mentioned in the lease. it's my understanding that they can't just throw random charges at you unless you cause something to have to be paid for. other than that, the tenant pays the rent every month for so many months.

as far as the cost of the card, it's $35, but what if i got in your face and bullied you for a dollar fifty? I just don't want to be taken advantage of. and actually, $35 is a lot to me. it's food for 4 or 5 days. and i'm not actively looking for an excuse off the lease, though I wouldn't mind leaving if i did have an excuse.

As someone else pointed out to you, you’re just looking for an excuse to break the lease. You’ve been there two whole months, - wow - :rolleyes: and now you want to use this lame excuse about a gate card and "being bullied" to try to get out of the lease. You’re obviously angry about other things (perhaps life in general), and you suddenly realize you moved into a place you can't afford, but that’s not the landlord’s fault or problem.

You can either pay the $35 or not pay it and park someplace else.

who are these people? I've posted this thread hoping to receive from people with helpful information about landlord/tenant law. if you're not one, but one of these people that go on the internet to put people down and their selves up in the process -pathetic- please move on. just looking for some helpful information thank you.

:rolleyes: Stop flattering yourself; you have no idea how I spend my time, spare or otherwise. Seems to me YOU are the one with the problem; i.e. trying to squirm out of a lease. Members have answered you, but not the way you want them to. boo hoo :( Call/hire an attorney, but I promise you it will cost more than the $35 that you're whining about.
