So after all this, saying the kids are in such a horrible home suppossed to go to court on the 28th, friday, his lawyer asks for at least a 60 day continuance? What is that about? Why would they do that? I am thinking b/c they know they can't win. I mean, I have done nothing wrong. But regardless, if the kids are in a horrible situation why let them stay here for 60 extra days??? Any sense? :confused:

Well they already have copies of everything. All dr. records, counseling records, school records, my records. Everything they already have as of the 6th of Jan.

It could be because they think that there might be evidence out there that they need time to obtain. It could be because he owes his attorney money and can't currently pay up. It could be because the attorney has a tight schedule and conflicts. Or it really could be because they realize they are losing and want to re-trench to see what other direction they might go. There are probably other possibilities as well. However you are correct, if the home was so bad then leaving them an extra 60 days isn't wise....so you should use that argument if and when you do have a hearing.

I don't have anything I don't want to give them. There is nothing 'bad' to have to give. I am open and would love for them to have all the dr. records, any other records, ect.....b/c I have nothing to hide. My lawyer states that they know they will lose in a trial so that is why the delay, and that they want to see if i will be willing to settle out of court, i.e. move to Indiana. Which I will not, or do not want to do.

I requested a gaurdian from the court as well, so we are waiting to see if the judge approves that, I guess this is a person who will talk to all the people involved w/ the children, teachers, dr's, after school workers, etc....both parents....and be the 'voice of the child' since they are young. And the ex's attorney said they don't really want that??? Makes no sense to me. :eek:
