A friend of mine was convicted of a crime he did not commit "sexual interference" - one count. He appealed the conviction and the Ontario Court of Appeals ordered a retrial. Apparently it is in the Crown Attorney's hand 's to decide whether there will be a retrial or not. My question is, this has been going on for over 3 years now and my friend is tapped out financially. He was told by his previous lawyer that all he can do at this time is wait for the court's decision. This is pretty much what he has been doing to finances but ... This lawyer has proved to be very incompetant and I wonder whether this is accurate information or not. Is there anything he can be doing right now besides waiting? It will be almost two months since the Appeals court made it's decision.
Some feedback would be greatly appreciated.
