Age discrimination

Since my Dad died a couple years ago, management at my Mother's company (where she worked for 25+ years) started dropping comments to her about her age and even asked if she planned to retire soon. My Mother, who is now 62, replied that she needed her job and had no such intentions. She never told other employees of her age, as she wanted to keep it private. Management and HR personnel have on occasion stated her age in front of others.

Yesterday, she was told they were reducing her hours from 5 to 3 days a week and cutting the amount they pay toward her medical coverage in half. They said they feel another person (young man) can take over a lot of her jobs with a new machine that she was not given the option of using. She has proven herself on other machinery over the years and become a knowledge base for many individuals there.

Today, a coworker informed her that someone in management told him and another employee that he felt bad about cutting her hours, but he needed someone with more versatility (hinting that a young man could do more than an older lady). He then announced her age to the other employees and said they figure she'd be retiring soon anyway.

Does she have a case?

Let me put it this way.

I think she has ample justification for calling the EEOC and/or her state discrimination board and saying she believes she has been the victim of age discrimination. I'm often hesitant to say that someone definitely has a case on the basis of a short post since we don't have all the facts, but the behavior of her managers is definitely suspect.

BTW, if they did not cut the premium payment of anyone else but only of your mother, it will be almost impossible for the management to defend a discrimination case on that basis alone.
