Hello.I am 16 years old,and I would like to say right off the bat that I might be pregnant.The father,and my current boyfriend as well as fiancee,is about to turn 20 in september.I have talked to a laywer about this topic befor,but I fear he was lying.I have a few questions for you so I can be sure or not he was telling me the truth.

My questions are as follows: 1)If my parents find out I am pregnant,can they have my boyfriend arrested,even though I am on his side?Like,he didn't rape me,and I am pregnant because we,((me and my b-friend)), both wanted it? 2)Do I become an Adult because I am pregnant,and therefor free to move from my home to live with my boyfriend,if he has a job and a place to live,and he can support myself and the new baby? 3)If my boyfriend is arrested,can he be put in jail,even though I testify for him that what we did was not rape?

My response:

Your lawyer was telling you the absolute truth. It makes no difference whether or not you testify on his behalf. The law, in these regards, acts on it's own, without the need of a "complaining party." In other words, when the D.A. finds out about your statutory rape, the D.A. does not need "permission" from anyone to prosecute your boyfriend. A minor, under the laws of these United States, does not have the "legal capacity" to decide and agree to have sex. It even makes no difference, under the law, whether your boyfriend knew if you were 18 or not. The worst evidence against him will be your birth certificate.

Pregnancy does not make you an adult. Your chonological age; i.e., 18 years of age, makes you an adult in the eyes of the law. And, even if you were to petition the court for emancipation today, that would not negate the fact that when you had sex, that you were a minor child at that time. What's done is done.
