My Girlfriend and I have been together for almost a year now and have been Sexually Active. However I have recently turned 18 and my girlfriend is only 16 years old. The Pennsylvania law states that the age of consent is 16 as long as the person is within 4 years. However I am unsure if there are any other laws regarding this that could potentially allow her father to bring me to court.

Regardless of the sexual activity, Dad can ABSOLUTELY get a restraining order against you until she's 18.

Tread VERY carefully, young man.

You see, her father isn't the sharpest tool in the toolbox, However I did need to know if this could be considered Corruption of a Minor.

Since you are the one schtuping a child without fully understanding the legal ramifications, I am not sure I would be judging anyone else's mental competence.

It will absolutely be considered corruption.

Actually we have held off until we can obtain advice from an attorney.

The reason why I am here and why I have been reading the law books, is to understand the laws regarding this, and what legal actions could be taken against me.

Also -

corruption of a minor is stated as

"The offense of engaging in sexual intercourse or other sexual activity with a person who is not one’s spouse and who is under the age of consent or another age set by statute, especially if there is a considerable age difference (usually four years or more) between the offender and the victim."

Since PA's age of consent is 16, and the fact that my girl friend falls on that age, along with my age being within 4 years makes this legal?

Except you said in your first post that you were sexually active.

Or wasn't I supposed to read back all the way to the top of the page?

Were is the key word there, We stopped before I turned 18 to determine the legality of us being together.

___________

Other than the restraining order and her being unable to see me does this mean there are no further problems?

Even though you are very much still a child yourself, you are not going to get anyone on this board to say it is okay to have sex with minor.

Frankly, I don't care what PA's age of consent is -- if you were screwing my daughter, you wouldn't be afraid of me going to the police -- you'd be begging them to come save you.

OH... so it was okay to sexually assault the little girl yesterday but TODAY you are wondering if you can still sexually assault her?

What do her parents think about you having sex with their child?

To understand the laws of your state, you would do better to consult Pennsylvania statutes and case law and not a generic law dictionary.

§ 6301. Corruption of minors.
(a) Offense defined.--
(1) Whoever, being of the age of 18 years and upwards, by any act corrupts or tends to corrupt the morals of any minor less than 18 years of age, or who aids, abets, entices or encourages any such minor in the commission of any crime, or who knowingly assists or encourages such minor in violating his or her parole or any order of court, commits a misdemeanor of the first degree.
(2) Any person who knowingly aids, abets, entices or encourages a minor younger than 18 years of age to commit truancy commits a summary offense. Any person who violates this paragraph within one year of the date of a first conviction under this section commits a misdemeanor of the third degree. A conviction under this paragraph shall not, however, constitute a prohibition under section 6105 (relating to persons not to possess, use, manufacture, control, sell or transfer firearms).

We can all bring our own opinions to this thread. However the OP is asking about the legalities of the situation not the moral one's.

Corruption of a minor would be a stretch because of the ages, especially depending on when she turned 16.

We tell people on here all the time that emotions and morality have no place on here and that this is a law site. So we should give answers according to the law not how we personally feel about the situation.

If this were my daughter I would look for any way possible to end the relationship but we have to also be realistic here. In this day and age the majority of teenagers are having sex at this age. If you think your 16 or 17 year old is not at least thinking about it you are living in a fantasy land.

Read first, talk second.

The little girl was below the age of consent when he started schtupping her.

Their ages mean that statutory rape is off the table due to their age difference.

Corruption is not.

Even better, the child has several years to decide whether or not to tell daddy and get him to press charges.

If I were the OP, I would be VERY nice to this girl. He breaks up with her, he gets to hope for jail rather than prison.

Pa. as well as most other states very seldom if ever anymore prosecute minors who engage in sex unless one of them is under the age of 13.

By the OP's own post the sex stopped when he turned 18 (so far, and if we believe him) Corruption would be a stretch in this situation if he was not 18 when they had sex.

A crime does not stop being a crime if you decide to stop committing it.
