What is the name of your state? Involves CT and VA

Here is the situation:

A girl who is age 16 and lives in Connecticut with her mother has apparently had a brief sexual encounter with a man who is much older and who lives in Virginia. As best I can tell, the initial contact was through the internet and it appears she initiated the contact.

The physical meeting happened in Connecticut.

I’m trying to figure out if a law has been broken here and/or what can be done if anything.

From what I’ve learned, the age of consent in Connecticut is 16 but it’s 18 in Virginia but I don’t know which’s state’s law applies. Is there a Federal law that applies?

Any information would be appreciated. Thanks in advance for your help!

Your friend needs an attorney now!

The state where the contact took place will govern the law on the age of consent. However, transporting a minor across state lines for illicit purposes can be a federal offense, and both states likely have laws against contributing to the delinquency of a minor or taking them out of their parents' control.

That seems like a very abrasive and unnecessary question...why does it matter to YOU why it matters to me and what does that have to do with my initial question? Since it seems important to you, it matters to me because my niece is the 16 year old.

For CdwJava,

The only interstate travel as far as I know was his travel to CT.

Because of the internet contact there could be other federal and VA state issues that also apply.

It is NEVER a good idea for an adult to fool around with a minor. There is just too much that can happen (aside form the obvious legal issues).

And Belize asked the question because it IS important and relevant. if you are a disinterested third party who is a "friend" of someone, then your "friend" is giving you information that can be used against him in court. Most the time we find that the "friend" in the story is usually the author.

if you are a friend, you do not know all the details and any advice or information related is suspect. If YOU are the guy who did this, then your version of events can be given greater credence.

Consider it from our perspective when most of us find the act of driving from VA to CT just to get a little underage "release" to be reprehensible and despicable.

And no crime has been committed. The age of consent in BOTH virginia and Conneticut is 16. You have false information.

Connecticut Gen. Stat. § 53a-90a - A person is guilty of enticing a minor when such person uses an interactive computer service to knowingly persuade, induce, entice or coerce any person under sixteen years of age to engage in prostitution or sexual activity for which the actor may be charged with a criminal offense. For purposes of this section, "interactive computer service" means any information service, system or access software provider that provides or enables computer access by multiple users to a computer server, including specifically a service or system that provides access to the Internet and such systems operated or services offered by libraries or educational institutions. Enticing a minor is a class A misdemeanor for a first offense, a class D felony for a second offense and a class C felony for any subsequent offense.

I also could not find anything under the VA law that he may have violated his state law (at least on this issue).

Read here for yourself:

http://leg1.state.va.us/cgi-bin/legp504.exe?991+ful+CHAP0659

Maybe you can find something in there that he did violate.

This seems like a lot of effort for a guy to go through to get a little underage (as in 'not an adult') tail. You'd think it would be cheaper just to remain at home!

Well, I dont have any info about his motives or why he would go to such trouble/distance...maybe he just figured it was "safer" for him in some way.

I appreciate all the quick and knowledgable replies.
