What is the name of your state? Al

My step son was 19 in late September of 2004, (he turned 20 in October) when he got his 16 year old pregnant. I know the age of consent in Al is 16.

My question is, is there not an age limit for the older person? I have researched this and the only thing I can find is the age of consent. My understanding is that as long as the younger one is 16 that it does not matter if the other is 30, 40 or 50 and that just really blows my mind. Does anyone know if this is right? Thanks in advance for your replies.
 


Couple of things:

(I assume that the girl consented to the intercouse, otherwise he could be legally charged with first degree rape. I am also assuming that the girl was physically and mentally capable of giving consent.)

According to Google as well as www.ageofconsent.com, when you reach the age of consent, you may have sex with someone else who has reached that same age as well. It shouldn't really matter how old the other person is, as long as there are no ties between them. For example, and I doubt this is the case, if your son was the girl's legal guardian, that would be an exception.

So as far as I was able to research, your son should be fine. He will, however, have to pay child support, which is a whole another complex issue.

Thanks for the reply. They have been seeing each other for almost 3 years. Yes she consented and after she finishes high school next year they plan on getting married. He plans on supporting her and the baby every way possible.

He has been working and saving since they found out. Although they both know they made a huge mistake, I think that both of them will do what needs to be done for the child, whether they get married or not.

It really just blows my mine that even though a 16 year can consent, that is ok for a for a 40 year old pervert to have sex with them. Thanks again.
 
Well, you also have to keep in mind that if the girl's sanity is intact, she will most likely not consent to having sex with a 40 year old pervert.
