What is the name of your state (only U.S. law)? Arizona, my fiance was recently arrested for an aggravated DUI. His Drivers License was suspended for previous traffic violations. There was property damage but nobody else was involved in the accident. Everything that I have read states that a DUI is aggravated when your Drivers License is suspended for previous DUI s. What classifies an aggravated DUI? He has past felonys but not DUI. Please help!

Arizona Aggravated DUI is one of the following:
1. A third or subsequent DUI offense within the previous seven years
2. Any DUI offense charged if the driver had a suspended, canceled, or revoked license when arrested
3. Any DUI offense charged while a minor younger than 15 years was in the vehicle.

He committed a class 4 felony aggravated DUI under number 2..

The minimum sentence a Judge can give him if convicted is 4 months in prison.
The maximum is 2.5 years.
His license will be suspended for 3 years.
Minimum probation after that will be 5 years.
Fines may be several thousands of dollars.
In some cases, the court can order the felon to pay for part of the incarceration costs...$40-$90/per day.

His past felonies can compound his problems/ sentence/fines..
