My common law husband was arrested in February for allegedly having oral sex with a 14 year old girl. There has been abuse in our relationship and there was police reports made by me. Will they call me to the stand regarding these incidents? There is no physical evidence in this case, it is his word against hers. Can you tell me what the likely hood of hime getting off of this charge is? We live in Texas.

My response:

Strange, and Freudian, choice of words: " . . . having oral sex with a 14 year old girl" and "him getting off."

Anyway, you aren't required to testify against your husband - - they can't force you. You are entitled to the marital privilege to not testify against a spouse.
