What is the name of your state (only U.S. law)? California

We are having a billing dispute with a vendor where they are suppose to notify us of any rate changes via certified or registered mail per our written agreement. Per their admission they changed our rates without following the process of notification, we paid the bills since 2011. By paying the bill since 2011 is this an acceptance on our part of the rate changes or is this a breach of the agreement where we can hold them accountable for the damages? IE we overpaid them.
