I was in accident in Dallas, Texas where the other driver was ticketed for not yielding the ROW. I hit the side of his car head on at 30 -35 MPH. Neither airbag opened in my 1995 BMW 325i.. much to the surprise of the paramedics. $10,000 damage to the front of my car. Since then I've had constant medical problems including pain injections, painful diagnostice procedures, fusion surgery for a torn 5S1 disc, infections, gall bladder removed due to infection, intestinal problems, severe back, leg and side pain with leg numbness and nerve damage and now have been recommened for a hystorectomy to prevent back and pelvic pain with possibility of more back surgery. (3 files of medical bills) I am only 34 years old and have had to quit work due to pain and lack of energy. An attorney handled the insurance settlement(recieved policy limit with no hesitation from Insurance company) however, he never pursued a lawsuit against BMW for the airbag after telling me in the beginning that he would look at that avenue,as well as, the employer of the person who hit me since the accident was @ 4:25 PM. Doctors believe the airbag would have prevented my injuries. After many requests to my attorney to pursue these avenues,(I have most of the emails between us) he finally told me a deadline had passed and he was not interested anyway.(I don't believe he new how to handle product defects but never referred me to someone who could help) Do I have a case against BMW, that attorney and maybe even the employer of the other driver if he was working at the time. Can I get help? I can not work and feel that I was not given the legal services that I should have. I had no idea how this would continue on at that time. Please help. How do I proceed?
