Many of you know the situation with bio-mom and you know how difficult she is. Well, we are trying to type up guidelines for airline travel to add to the order. Yes, it is long, but when dealing with her, it is best to have all of the bases covered and not leave anything up for interpretation.
Please let me know if it's okay and if I left anything major out:
Either party may elect to transport child via major airline by following these guidelines:
(Raleigh-Durham International Airport is noted as RDU, Atlanta-Hartsfield International Airport is ATL)
a. If Defendant chooses to use airline travel for those visits that she is responsible for transportation, she shall be solely responsible for booking and paying for the roundtrip airfare as well as any additional fees associated with the flight.
If Plaintiff chooses to use airline travel during those visits that he is responsible for transportation, he shall be solely responsible for booking and paying for the roundtrip airfare for Defendant’s visit, as well as any additional fees associated with the flight.
Plaintiff shall be responsible for child’s transportation to and from ATL.
Defendant shall be responsible for child’s transportation to and from RDU.
b. Winter Break during odd years, when transportation is split: If both parties elect to use airline travel in lieu of road travel for these visits, Defendant will be fully responsible for booking the roundtrip flights including airfare and fees. Defendant will use her best judgment in finding the most affordable airfare available.
Defendant will provide Plaintiff with a copy of the receipt for the flight and all associated fees within 30 days after conclusion of the visit, in order to be reimbursed for Plaintiff's portion of the airfare and fees. Plaintiff will send reimbursement within 10 days of receipt. If Plaintiff does not receive this receipt within the 30 days, he will not be held financially responsible for any airfare associated with the visit.
If only one party elects to use airline travel for his/her transportation responsibility, he/she will be solely responsible for all booking, airfare costs and associated fees.
c. Notification: The parent booking the flight will notify the other parent of their intent to use airline travel for the visit in writing, and include the ticket and boarding passes with the written notice. Notice must be received at least one week (7 days) in advance of the departure date. If this notification is not received 7 days in advance, it will be assumed that airline travel will not be used for the visit. The individual responsible for the transportation understands that he/she may be required to find alternate transportation for child, or change the flight times, depending on plans/conflicts of the other parent.
d. Scheduling: Flights shall be scheduled for departure from ATL no earlier than 6:00pm on any Friday the child is in school. Arrival time at ATL shall be no later than 5:00pm at the conclusion of the scheduled visit.
School Holidays: If Friday is a school holiday, flights may be scheduled to depart no earlier than 12:00pm for from ATL.
e. The Plaintiff, Defendant or Plaintiff’s spouse must take child to the gate at departure and meet him at the gate at arrival.
