I was recently fired from a vessel I was working on for the '00 Gray Cod season---and had signed a contract for such. The skipper/part owner of the boat fired me, saying he did not have "a problem with my work ethic," but that his brother needed the money. His actions were in this order:--he hired his brother first (he signed authorized a personal fishing gear draw for his brother); his brother proceded to move on the boat. Is wrongful firing in favor of nepotism grounds for a civil per/inj lawsuit??

Not in California it isn't. Other states laws may be different. However, you speak of a contract of employment that you had with the skipper. That may be your best bet. If the contract states in effect that you were to work from time period A to B, that you could only be terminated for XYZ, and yet you were not terminated for those reasons. Thus, your skipper breached your contract of employment. So I suggest that speak to an employment law attorney near you. You can find one at attorneypages

jimibear, if you have a written contract and the captain breached the contract you are entitled to the benefit of the contract. There may be mitigating factors though like was other employment available that you could take once you learned of the firing. Contact a maritime or admiralty attorney in AK. You may be entitled to the full contract wage if the facts bear it out.
