You both knew of every financial responsibility each of you had before you decided to have a child that you now claim you can't afford.
If you are both working, you should be able to support your bills, if you can't, then you need to upgrade your current jobs to better paying ones, because the financial responsibilities aren't going to go away, in fact they'll be increasing with every additional child. Why are the expenses regarding the kids such a concern now all of a sudden, when they have existed since day one you got together?

You and hubby may have bigger problems than you realize.

Is your husband even legally divorced at all?

He needs to get a copy of EVERYTHING from the court file to determine exactly what is in the court order and to determine if the divorce was ever finalized (signed by a Judge). You said that your husband said that "they" never went before a Judge and that a friend of his ex's is the person filing the papers- so it is very possible that he isn't legally divorced at all.

He needs to look into this TODAY- do not wait.

And in the meantime, stop paying the bloodsucking ex. Keep the money aside just in case.

I'm pretty sure that the divorce is final...we got married in Mexico and in order to get the correct paperwork, he had to show proof of his divorce. Not too sure what the lawyer friend was thinking about. Does any one know how to go about submitting an order for modification? I'm ready to get this overwith.

God forbid I should *upset* you by being blunt, but do you understand that conditions must be met to modify, if modification is allowed at all in his case? It's not just a matter of filling out some forms because you and your husband don't want to pay his X any more.

For anyone here to help you, you'd need to post his alimony clause/s, word-for-word. Then, from what I posted yesterday, he'd likely need to prove that his X is living with someone. You never addressed that -- is she?

Silverplum- we have no idea if she is living with anyone or not. I do not know word for word the lingo that was used in their settlement. We do not just want to stop paying her, we feel that she has gotten way more than she should have. She is now working and able to support herself. Her earning potential is way more than my husbands. I just found a florida law site and it says that we would need to prove a substantial change in circumstances to modify the agreement. I believe that we can do that. Thank you for your input...sorry if I got upset yesterday at your post...just very frustrating situation to see someone you love being taken advantage of over and over again. :)

The problem is unless the substantial change happened since the divorce, it doesn't count. And what was the substantial change? The word for word lingo is EXTREMELY important. Some people have unmodifiable alimony included.
