I guys I hope you can help
we are appealing the district court judgement, On December 1, 2002 the landlord shows up demanding that we leave the property, the landlord threatens my husband in front of the police officers that she called, "we we do anything to get you out of this house even if its on christmas eve" from my understanding we can stay in the house until the appeal,, the appeal is stated to take place on September 3, 2003. She has put up a for sale sign in front of the house and has attached a lock box we were told they will enter regardless if we are here or not, Can they continue to put the house on the market and have people enter here knowing the judgement is in appeal. Can we bring charges for hassarments threats and the like? this is too damn stressful. can she give us another month to month lease?

well do you have a years lease or is it month to month?

What was the judgement for?

Yes she can sell the house anytime she wishes, but will she find a buyer?

Cor If a realtor shows up at the house wanting to show it to a prospective buyer and you havent had reasonable notice . You can firmly with out being nasty tell the realtor as they know since this is a rental unit . For sale or not you must be given reasonable notice for non emergency entry , that you are busy and cannot be disturbed at this time , and shut the door . If your LL comes with dont get into shouting match still just shut the door lock it and If they try to enter anyway call the police .

hi guys thanks for the replies
part two the landlord is taking us to civil court, according to the state of Pa we had ten days to appeal the decision of the district court which has to be filed by friday the day after thanksgiving however since it was a holiday we were given until monday the second of december, which we filed and have given the court the decembers rent. she has stated in this civil paper that we did not file in a timely fashion, false,,and also stated that we were given a thirty day noticed delieved by over night we never received any notice until november 5, 2002 which was taped to the doors in the house,, NOW CAN WE SUE THIS individual,, I sick of her lies and evilness and in fact her threats are making me afraid to live in the house. she has taken out an insurance policy of 150, 000 on this property and the house is only worth 65,000 desperate people do desperate things
please help oh ps she claims she cant sell the house but yet their is the for sale sign on the front grass,,,, Hey can i send her my gas bills that are out of sight?? just asking thanks again

why are you gas bills outta sight? how many apartments are there? maybe you are paying for everyones gas.

or the gas heater has some vents that are not connected. where are the ducts under the house, and probably UN insulated......wasting tons of money

The friday after thanksgiving is NOT a holiday, but some states do close the courts, in which case monday Dec 2nd is the proper time to file.

the door is not properly adjusted to the door jam,, you can put your fingers into the gap
there is no insulation under the floors and the back door does not have the glass.
i have to put a towel near the base of the door to keep the draft out and also has started to wrap the door in a blanket to close the gaps to keep the cold out

this can be come long and wordy and Im sorry if goes that way
the LL has been trying to sell the property since june of this year we had a month to month lease and paid our rent on time we let the potential buyers in and all, we have been called pigs and that our furniture was not selling the property, any way, on october 28 things really got out of hand, the kids called at work stating that the LL wanted to show the house at 8 that night,,, ( which was not 24 hours noticed) any way when I called the realtor office i was informed that there was not to be a showing that night I get home from work and my husband is not happy with me he was told that I cancelled anothe showing,, a showing that was not supposed to even happen,,,, and the realtor stated that her secretary lied about Me cancelling,, anyway, the realtor threaten my husband stating that they will do anything to get us of the house,, we filed a complaint with the police departmen, and also to consumer affairs about the condition of the house. the rent money for the month of november is in escrow where it is today and gaining some interest. the landlord takes us to court and wants the novembers rent plus late fees for that month along with other late fees. which the judge did not award her any late fees,,, the judge awarded her the court costs along with novembers rent,, we are appealing the decision because we feel she wants us out because we complained to the comsumer affairs office.. now today we get a civil complaint stating that she cant sell the house because of us,, we did not destroy the tub or the living room ceiling, the district court was showed the pictures of the house before we moved in, and yet the house is back on the market with no repairs done to it..she asked for 94,000 dropped it down to 87,900 and now she is asking for 92,000. I have taken days off from work to make sure the house is cleaned and all but yet people walk in and out in 5 minutes or less. The living room ceiling is coming down the glaze in the tub is gone, she claims there is a wet/dry bar,,, where, someone point me to this because hell i can sure use a drink,,,,she has lied to the district court about the 30 days notice to terminate the lease it was NEVER DELIEVED by over night express in fact her own lawyer stated that they could not deliever it to us until november 5,2002,, Im sorry but i told you this gets lengthy

Use what ever proofs you have and give her hell ALSO do you have any written reports from a city county inspections unit ? again use pictures of the things that need repairs INC new pics of the ceiling wide objects slid into the door jamb areas that need weather strip ( like a pencil sliding in ) same with bottom of door new pics of the bath tub etc allow your pictures and any proofs you have from housing inspections unit to back you up RE her suit feel free to tell a Judge that you arent preventing her from selling and the pictures of the house ought to show him /her why . have with you copys of your other court records. the Judge might wish to review them . COR In your state or city are truth in housing reports required ? the reason I ask is if you can get a copy perhaps that as well will show the damage since it would be listed by the inspector. PS about your backdoor glass being gone if you have to put cardboard over it and staple it to the door and duct tape it . or see if you can find a piece of scrap plywood to put into it . atleast it might help lower the gas bill just a bit.

we have lots of pics and yes we are giving her hell, she has taken $25,000 in rent over the last two years and has done nothing to improve her own property,, she has gone out and brough the top of the line sebring,, makes me wonder, we are getting the inspectors in here,, the landlord and her representatives came on december 1 demanding we get out of the house,, she even called the cops and threaten hubby in front of them stating that she will do anything to get us out of here,, this is horrible,, one of the kids was in the house while this was all going on,, poor thing,,:-(
I used to be a trusting person but after this i have become a hard assed person,,thanks again

the kids like the neigbhor and the schools are very good
plus my husband and I have not soo good credit
we are paying off bills and the like
and with him being activated to go to over seas(middle east) we did not want to cause more distress to the kids
we also feel she is doing this because we have been telling her that hubby might and now the case is will be activated to the middle east. I know there is a federal law to help with people in the military,, I have told hubby that when he goes I fear that she and her people will cause even more distress to the family..

I just want to comment on one thing I saw in an earlier post: you mentioned that 'her lawyer even admitted they couldn't deliver notice to us until Nov 5'. If she has a lawyer, you need one too. Find a lawyer who knows the laws and arrange for a consultation. If the lawyer thinks s/he can get attorney fees awarded, s/he might take the case based on LL having to pay the fees.

Also, start keeping a written diary of every communication with this woman, so you have a complete record of who said what when.
