Also, is it too late for a relief of stay?

I really figured there was no way this BK would be confirmed because it's just so full of lies and baloney, but now I'm told that often doesn't matter and it could easily be confirmed anyway. The whole filing was just to avoid my litigation against the debtor. I didn't file a motion for relief of stay because I figured the whole stupid BK would get thrown out.

So the confirmation hearing is tomorrow, and I'm worried, and I'm wondering if it's too late to file a motion for relief of stay so that my suit can proceed or at least get an adversarial proceeding or something. I think I put all my eggs in one basket.... Any help?

I don't think its too late at all. File the Motion for Relief. If its granted, and your litigation goes thru, then you might be able to get evidence of his fraud thru discovery in that case.
