9/98 Got 2nd mortgage using real estate and boat and trailer as collateral.
6/99 I used trailer and boat as collateral on small loan.
8/99 I used real estate to refinance 2nd mortgage with same company. Boat and trailer not used as collateral this time on this loan.
12/2000 I paid off 6/99 loan. Mortgage Co slid over title to loan..adding it to 2nd Mortgage contract (overwriting previously XX out motor vehicle lines.
I was not aware of this till I called in Feb2000 to ask why I had not received title back yet. Was told it was sent out in late Jan. Then got message title had been slid over to 2nd mortgage contract. Am I to assume that them altering my contract and then returning the title leaving the contract still altered is OK. Is this not deceitful and fraudulent?

I wouldn’t necessarily call this deceitful and fraudulent; however, unless you agreed previously in one or the other of your loan contracts to have them slide over the title to the boat and trailer to the 2nd mortgage upon the pay off of the 6/99 loan, they had no authority to do so, and you have a right to have them remove the liens on the boat and trailer.
