Am I being Discriminated upon?

Hello.

I am having a problem with SSI now I am not in the wrong forum I need to ask if I am being discriminated against ,

racially & otherwise.

I have been denied SSI benefits 3 times .

The case has been remanded back by the appeals counsel & still with the amount of Medical evidence this judge makes a unfavorable decision on my part.

Now, my attorney & I wait almost 3 hours .
When we get into the judges court room she did not apologize for the delay & did not ask a single question neither did the Vocational expert.

I wonder how I can determine if its racial, sexual or what.
my inner voices that whisper stuff to me is screaming,

"Something is not right"


Any & all advice is greatly appreciated.

Most certainly you were discriminated against, but not all discrimination is illegal or actionable.

You were discriminated against because your case was scheduled later in the docket than earlier cases. Those cases, or other work, took longer than planned, and thus you were heard three hours late. This does not require an apology by the judger - he did not do anything wrong to you. Furthermore, the judge may have already had all the information he required, and did not require further information from you or your attorney. The hearing, even if unnecessary in the instant case, may have been required by state law, or perhaps your attorney wished to make some oral argument to the judge.

You have not presented any specific facts to us that would suggest that this judge acted in this brusque manner towards you (which caused you no damage at all), or that you have been denied social security benefits, on the basis of your race, sex, religion, or creed. Without the existence of such facts, you have no case.

Upon reading your reply I have to agree.

In a last ditch effort I am requesting the written transcripts from the proceedings , any way .

There are a lot of mistakes & embellishments .

My next goals are to go thru all the stuff & fill in the gaps they deliberately excluded.

Maybe I will know something about SSI laws by the end of my quest.

Any directions in reading & research you might suggest?

My advice? Talk to your attorney. You've retained him to provide you representation and counsel. He would be the best person for you to talk to if you think that things happened in an inappropriately irregular manner, since he was there and represented you all this time.

Would you say this is more a civil mater?

My Attorney is extremely competent in SSI law but as far as this subject I do not think its in her forte'.

I know I am not a lawyer ,but when I get my teeth into somthing I don't let go.

When I start asking questions no one want to answer them.

I feel Its up to me @ this point .Because I can not afford to buy another lawyer.

This would be a civil matter, yes.

While your attorney is a specialist in SSI benefits, he had to go through law school, pass the state bar, and probably do some general practice. Never mind that any good attorney reads trade magazines and other publications, and thus picks up on information not immediately relevant to their specialization.

While your attorney might not feel comfortable actually litigating any discrimination matter you may have, he most certainly can talk to you about the process you've been through, and whether or not he feels you have been illegally discriminated against throughout the process. He probably has handled many, many cases such as your own, and is very familiar with the ways in which the system properly operates. In any event, he's been representing you through all this, and probably has more knowledge about the legal aspects of your case than you do.

I hate to say it, but the justice system is slow, and judges are overloaded. They have a natural and understandable desire to get things off their desk. They have no requirement to rule in your favor, nor does the state have a requirement to approve your disability claim. Just because they turn you down, doesn't mean that they illegally discriminated against you.

I am not Biased because its me.

My attorney works for the largest Disability in the nation.


She is one tough cookie. I have been impressed @ how things have been handled.
I have spoken many times @ lenght to the head guy of the firm.& he agrees the system is flawed if not broken.

She has told me my case is the most extreme case she has seen as far as the judges not paying attention to the facts.

The Bottom line is this :

They {SSI} has put more weight into doctors I have only seen once {upon SSI's request} than doctors I have seen for years.

They have ignores MRI's Cat scans milogram's spinal tap's nerve root blocks , EMG's & & Multiple nerve conduction tests & the need to be on Heavy medication for many years.
{The alphabet soup I don't even remember what they mean any more}

Now my opinion. this is nothing more than governmental incompetence.

can you steer me into the right direction on obtaining certain Judges track records & stuff like that?

I just don;t know how to search for what I am looking for .

I have a long way to go & a short time to get there.

It real suck when I have to do the Lawyer's ,the Doctor's ,the Pharmacy's & the Insurance Co.'s jobs & have to pay them too. plus try to cope with my illnesses.

It works like this :
We all speak English. but they all speak a different lingo & none of them can communicate with each other with out a freaking interpreter.

Are the any advocacy people that can help me get my direction?

Big or little I need all the help I can get.

I am sure there is no one that cares enuf to help in this type of case.
Not to sound like I am whining . But I really hate chasing my tail .
