We bought a house in December 2000 and contracted with a local kitchen cabinet business(that has been in the business for over 50 years) to install some cabinets and countertops in our kitchen to match our existing cabinets.

The design consultant came and measured all the spaces and also our microwave since one of the things she had suggested was putting in a microwave cabinet. She said since our microwave was larger than the normal one she would have to order a larger cabinet but should be no problem.

Well to make a long story short, the microwave cabinet arrived and was installed by our contractor and then he tried to place the microwave, which did not fit!

We then called the company who said that they would come over to see what could be done. They came over, offered us a new microwave to fit the cabinet that they installed. We said No, because we already had our own microwave that they had said would fit into the ordered cabinet.

Then they said that they would modify the cabinet so that the microwave would fit. Well the way the cabinet is constructed this would entail tearing apart the entire cabinet and putting it back together. We did not agree to this option either since we had paid for a brand new cabinet that would accomodate our existing microwave that they had measured.

Well we tried to deal with them but was getting nowhere they do not seem to see that they made an error in ordering, they then decided to give the case to their lawyer to handle(mediate). Well we have left 4 unanswered messages with the lawyer and we are thinking of filing in small claims court.

Do we have a chance??

Thanks for your help
