Today I discovered that an employee of mine, one who was hired years ago by my predecessors, was not given a thorough background check. He was a violent offender and I want him terminated immediately. However, I do not have a copy of his original application to see if he did deny criminal history. Can I demand he fill out another one for my paperwork, and then fire him on the spot if he claims no criminal history?

It is true that many employers terminate an employee for lying about serious criminal matters on the employment application. The Human Resources department usually keeps those applications. From reading between the lines of your question, you are really asking how best to protect the company in its effort to terminate that particular employee. This question is only for your company's inside counsel or an outside attorney to answer.
